Partners Health Management is required by state and federal regulations, including the Social Security Act and 42 C.F.R. § 433 Subpart D, to identify and recover third-party liability claims, including those related to subrogation.

Subrogation is applicable when a Medicaid beneficiary receives services due to an injury caused by a third party. Examples include:

  • Automobile accidents
  • Sports injuries
  • Workplace injuries
  • Defective products
  • Medical malpractice
  • Neglect or abuse

When such an incident occurs, the Medicaid program may seek to recover payments for related medical services. This is based on the beneficiary’s legal assignment of rights to Medicaid as a condition of eligibility under section 1912(a)(1)(A) of the Social Security Act.

  • Medicaid can only recover from the portion of a settlement or judgment specifically designated for medical expenses.

If you have a client or case that may be subject to subrogation, please contact the Partners Subrogation Team at: PartnersSubrogation@PartnersBHM.org.

To help us evaluate the case, please submit the following along with a completed Authorization for Use, Disclosure and Exchange of Protected Health Information form:

  • Member’s full name
  • Medicaid ID number
  • Payor (e.g., Partners Health Management)
  • Type and date of injury
The Finance Department works with both providers and vendors conducting business with Partners.
